By accessing or using the Mana BioHealth website located at manabiohealth.com (the “Site”) or by using any of our wellness services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or services.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Mana BioHealth Wellness Center provides bioenergetic wellness therapies, health technology products, and related educational content. Our services include but are not limited to:

• Disclose all current medications, supplements, and treatments;
• Disclose all diagnosed and undiagnosed medical conditions;
• Obtain written clearance if you have a serious, chronic, or acute medical condition;

3.5 No Physician-Patient Relationship. Your use of this website, submission of any form, purchase of any product or service, or communication with Mana BioHealth staff — whether in person, by phone, by email, or through any other channel — does not create, establish, or imply a physician-patient relationship, a therapist-client relationship, or any other licensed healthcare professional relationship of any kind.

3.6 Do Not Disregard Medical Advice. Do not disregard, delay seeking, or discontinue professional medical advice or treatment because of information you have read on this website or received from our staff. If you have concerns about a health condition, consult your doctor immediately.

3.7 Known Contraindications. Certain wellness technologies and therapies may be contraindicated for individuals with specific health conditions. You must disclose all relevant health information to our staff before receiving any service. Known contraindications include but are not limited to:

3.8 Emergency Medical Situations. If you are experiencing a medical emergency, call 911 or your local emergency services immediately. Do not contact Mana BioHealth in a medical emergency. Our staff are wellness practitioners, not emergency medical responders.

3.9 Individual Results Disclaimer. Health outcomes from our services are not guaranteed. Individual results may vary significantly based on age, health status, severity of condition, consistency of use, lifestyle factors, concurrent medical treatments, and other variables outside our control. Testimonials and case studies shared on this Site reflect the individual experiences of specific clients and are not intended to represent or guarantee that all clients will achieve the same or similar results.

4.1 Voluntary Participation. Your use of any wellness service, therapy, or technology product offered by Mana BioHealth is entirely voluntary. By choosing to use our services, you acknowledge that all wellness activities carry inherent risks, including the possibility of physical discomfort, adverse reactions, or unforeseen health effects, even when services are provided with reasonable care.

4.2 Assumption of Risk. You voluntarily assume all risks associated with your use of Mana BioHealth services, products, and technologies — known and unknown — including but not limited to risks arising from pre-existing health conditions, undisclosed medical history, interactions with medications, and individual physiological responses to bioenergetic therapies.

4.3 Informed Consent. Prior to receiving services at our facility, you will be asked to sign an informed consent form. That form is incorporated by reference into these Terms. By signing it, you represent that:

• You have had the opportunity to ask questions and have received satisfactory answers;
• You understand the nature, purpose, and potential risks of the service(s);
• You have accurately disclosed all relevant medical conditions, medications, and contraindications;
• You consent to receive the service(s) of your own free will;
• You are of legal age or have obtained parental/guardian consent for a minor.

4.4 Right to Refuse Service. Mana BioHealth reserves the right to refuse, modify, or discontinue any service at any time, without liability, if we have reasonable concern that the service may be unsafe or contraindicated for a particular individual, or if the client fails to disclose relevant health information prior to service.

4.5 Responsibility for Health Decisions. You acknowledge that all decisions regarding your health and wellness are yours alone. You accept full responsibility for any and all health decisions you make in connection with your use of this Site and our services. Mana BioHealth is not responsible for the outcome of any health decision you make based on information obtained from this Site or from our staff.

When booking a therapy or wellness package with Mana BioHealth, you agree to the following:

• Scheduling: Appointments are confirmed only upon receipt of a confirmation from our staff. Booking requests submitted online are not considered confirmed until you receive a confirmation.
• Cancellations: We request at least 24 hours’ notice for cancellations or rescheduling. Late cancellations or no-shows may result in forfeiture of a therapy from your package.
• Tardiness: If you arrive late, your therapy may be shortened to avoid impacting other scheduled clients. You will be charged for the full therapy.
• Health Conditions: You are responsible for disclosing any health conditions, medications, or contraindications to our staff prior to your therapy. Mana BioHealth reserves the right to decline service if a therapy is deemed unsuitable for your current health status.
• Package Expiration: Therapy packages are valid for the time period specified at purchase (typically 3 months). Expired therapies are non-refundable.

All prices listed on our website are in US dollars. By purchasing a service or product, you agree to the following payment terms:

• Payment: Payment is due at the time of purchase or at the time of service unless a prior arrangement has been made with our staff.
• Refunds: Unused therapies in a package may be refunded on a prorated basis within 30 days of purchase, less a 10% processing fee, provided no more than one therapy has been used.
• Non-Refundable Items: Completed therapies, expired packages, and digital or downloadable products are non-refundable.
• Product Returns: Physical products may be returned within 14 days of purchase in original, unused condition with original packaging. Return shipping costs are the responsibility of the purchaser.
• Affirm Financing: If you use Affirm to finance your purchase, your loan agreement is directly with Affirm and subject to their terms and conditions.

9.3 Exclusion of Consequential Damages. To the maximum extent permitted by applicable law, Mana BioHealth, its owners, officers, directors, employees, independent contractors, affiliates, agents, successors, and assigns (collectively, “Mana BioHealth Parties”) shall not be liable to you or any third party for any:

9.4 Cap on Liability. In all cases, regardless of the form or basis of the claim (whether in contract, tort, negligence, strict liability, or otherwise), the aggregate maximum liability of the Mana BioHealth Parties to you for all claims arising out of or related to your use of the Site or our services shall not exceed the total amount paid by you to Mana BioHealth in the twelve (12) calendar months immediately preceding the event giving rise to the claim, or $100 USD — whichever is greater. This cap applies even if Mana BioHealth has been advised of the possibility of such damages.

9.5 Bioenergetic Technology Specific Disclaimer. You acknowledge that bioenergetic and frequency-based wellness technologies — including but not limited to Terahertz frequency devices, Tesla Plasma systems, Hyperbaric Oxygen chambers, and bioelectric scanning equipment — are wellness tools, not medical devices approved for the diagnosis or treatment of disease. The Mana BioHealth Parties make no representations regarding the therapeutic efficacy of these technologies for any specific medical condition. You assume all risk associated with voluntary use of these technologies.

9.6 Third-Party Actions. The Mana BioHealth Parties are not liable for the acts, omissions, errors, representations, warranties, or negligence of any third-party service provider, manufacturer, supplier, or technology developer whose products or services are referenced on or accessible through this Site.

9.7 Jurisdictional Limitations. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, certain limitations above may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9.8 Essential Basis of the Bargain. You acknowledge and agree that the limitations of liability in this section reflect a reasonable and fair allocation of risk between you and Mana BioHealth, and that Mana BioHealth would not have provided services or access to this Site without these limitations. These limitations are an essential element of the basis of the bargain between you and Mana BioHealth.
